2.0 Trademark types and definitions


Your products and companies are identified via your trademarks. Customers know the names of your products and often these names become references such as Kleenex, Google, Coke etc. So a name is something very important and a huge asset.

There are different Types of Trademarks that can be registered (Information provided by EUIPO):

2.1 Word mark

A word mark consists exclusively of words or letters, numerals, other standard typographic characters or a combination thereof that can be typed.

2.2 Figurative mark

It is a trade mark where non-standard characters, stylisation or layout, or a graphic feature or a colour are used, including marks that consist exclusively of figurative elements.

2.3 Figurative mark containing word elements.

A figurative mark consisting of a combination of verbal and figurative elements

This trade mark type is not a separate categorie under the EU trade mark Implementing Regulation. It is differentiated in the e-filing for practical and technical reasons.

2.4 Shape Mark

A shape mark consists of, or extends to, a three-dimensional shape. It can include containers, packaging, the product itself or its appearance.

2.5 Shape Mark containing word elements

A shape mark that contains verbal elements.

2.6 Position mark

A position mark consists of the specific way in which the mark is placed or affixed to the product.

2.7 Pattern mark

A pattern mark consists exclusively of a set of elements which are repeated regularly.

2.8 Colour (single) mark

A colour single mark is just that – a trade mark which consists exclusively of a single colour (without contours).

2.9 Colour (combination) mark

A trade mark which consists exclusively of a combination of colours (without contours)

2.10 Sound mark

A sound mark consists exclusively of a sound or a combination of sounds.

With the abolition of the graphical representation requirement, as and from 1 October 2017, EUTM applications for sound marks can only be an audio file reproducing the sound or an accurate representation of the sound in musical notation.

The Office accepts the following file formats: JPEG, MP3 (maximum 2 Mb)

2.11 Motion Mark

A trade mark consisting of, or extends to, a movement or a change in the position of the elements of a mark.

The Office accepts the following file format: MP4 (video), JPEG (for series of still sequential images).

2.12 Multimedia mark

It consists, or extends to, the combination of images and sound.

The Office accepts the following file format: MP4 (maximum 20 Mb)

2.13 Hologram mark

This is a new category of trade mark (as and from 1 October 2017). Hologram marks consist of elements with holographic characteristics.
