4.0 Trademark Checklist


What do you need to consider before registering your trademark? Most application fail because either someone registered the mark beforehand, or because the mark was not distinctive but not descriptive.
Going through this list, which is provided by EUIPO, might help you registering your Trademark successfully.

5.1 Your strategy

Are you sure if this is the correct mark for you?

Does it fit into your overall IP Portfolio strategy?

5.2 European Union Trademark

Can it be represented clearly and objectively?

Is it distinctive but not descriptive?

Have you checked that the mark or a similar mark already exists?

5.3 Goods and Services

Have you made a list of the goods you want to sell and / or the services you want to offer?

Have you checked which category of the Nice Classification they belong in?

5.4 Ownership

You will have to provide us with accurate details of the proprietor of the mark. Do you have this information?
